1. Agreement to Terms
These Terms of Sale (“Terms”) govern the purchase of all jewelry and products from RogueDesigns. By placing an order on our website, you agree to be bound by these Terms. We reserve the right to update these terms at any time, and the version in effect at the time of your purchase will govern the transaction.
2. Intellectual Property & Original Design
All jewelry designs, photographs, website content, and branding are the exclusive intellectual property of RogueDesigns. The purchase of a one-of-a-kind item grants the buyer ownership of the physical piece but does not transfer any reproduction or design rights. Copying or recreating RogueDesigns’ intellectual property is strictly prohibited.
3. Handcrafted Product Nature
RogueDesigns specializes in one-of-a-kind, handcrafted items. As such, each piece possesses unique characteristics. Natural stones, metals, and textures may show variations from the digital imagery provided on the site. These variations are a hallmark of artisanal jewelry and are not considered manufacturing defects.
4. Returns, Refunds, and Manufacturing Defects
4.1 All Sales Final. Due to the unique and one-of-a-kind nature of our inventory, RogueDesigns does not accept returns or issue refunds for convenience, ‘change of heart,’ or buyer’s remorse.
4.2 Manufacturing Defect Exception. We take immense pride in our craftsmanship. If a piece is found to have a genuine manufacturing defect, RogueDesigns will work with the buyer to remedy the issue, subject to the following conditions:
- Notification Window: The buyer must notify RogueDesigns within 7 days of receipt of the item, based on verified carrier tracking data.
- Evidence Requirement: The notification must be accompanied by high-resolution photographs clearly demonstrating the alleged manufacturing defect.
- Seller’s Discretion: The determination of what constitutes a manufacturing defect versus wear-and-tear, accidental damage, or improper handling is at the sole analysis and discretion of RogueDesigns.
If a defect is confirmed by RogueDesigns, we will, at our sole discretion, offer a repair or a store credit. Because our items are one-of-a-kind, exact replacements are not possible.
5. Care and Maintenance
Jewelry is delicate and requires proper care. Damage resulting from exposure to chemicals (perfume, chlorine, lotions), physical abuse (dropping, crushing), or improper cleaning is not a manufacturing defect. Buyers are responsible for maintaining their jewelry according to standard fine-jewelry care guidelines.
6. Shipping and Risk of Loss
Risk of loss and title for items purchased from RogueDesigns pass to you upon delivery of the items to the carrier. RogueDesigns is not responsible for shipping delays caused by carrier issues, customs, or incorrect address information provided by the buyer.
7. Limitation of Liability
To the maximum extent permitted by law, RogueDesigns shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products. Our total liability to you for any claim shall not exceed the purchase price paid for the item in question.
8. Governing Law and Jurisdiction
8.1 Governing Law. These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of Texas, United States, without giving effect to any choice or conflict of law provision or rule (whether of the State of Texas or any other jurisdiction).
8.2 Exclusive Jurisdiction. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the products sold by RogueDesigns shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas, in each case located in the County of Collin or Denton. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
8.3 International Sales. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded and shall not apply to any transactions conducted through this website.
